1. Terms and Conditions
1.1 The terms and conditions apply to OneGreatTicket.com (hereinafter referred to as the “site” or “website”), a division of HiFive Services Inc. (hereafter referred to as “Us”, “We”, “Our”, or “OGT”), any page derived from this website or any other pages owned by OneGreatTicket and the users of our services. 1.2 The party presenting the event is referred to as the “presenter”. This may include, but is not limited to, a promoter, producer, team, band or venue. 1.3 The user of the website, the purchaser of the ticket and/or attendee of the event are referred to as “you” or “your”.
2. Terms of Transactions
2.1 The terms of transactions set out the terms and conditions that apply to all purchases of tickets from the website OneGreatTicket.com. If you purchase a ticket from this website, you are deemed to have accepted these terms and agreed to be bound by them. 2.2 OneGreatTicket.com reserves the right to vary these terms of sale at any time. Any variation will be effective immediately after posting of the amended terms on this website. These terms were last updated on May 31, 2013. By purchasing tickets from this website after this date, you agree to be bound by the amended terms of sale.
3. OneGreatTicket as Intermediary
3.1 We sell tickets as an agent for and on behalf of the presenter. Any representations made by the presenter with reference to the event and any associated claims or complaints are the responsibility of the presenter and not OneGreatTicket. 3.2 Each ticket is a licence granted to you by the presenter to attend the event, therefore the contract regarding your attendance to the event is between you and the presenter. 3.3 All tickets are subject to the presenter’s terms and conditions. It is your responsibility to ensure that you are familiar with the presenter’s terms and conditions. 3.4 If there is any inconsistency between these terms of sale and the presenter’s terms and conditions, or these terms of sale are silent on an issue, then the presenter’s terms and conditions will prevail to the extent of such inconsistency / silence. 3.5 We do not guarantee the amount of tickets sold for an event. While efforts will be made to offer visibility to the event, the marketing of the event rests solely with the event organizer.
4. Seat or Ticket Availability
4.1 We do not set the ticket prices or determine seating locations as tickets are sold on behalf of the presenters. 4.2 We do not control the inventory or availability of tickets for an event.
5. Transaction Processing
5.1 Tickets are priced in Canadian Dollars (CAD) unless otherwise stated. 5.2 Ticket price may or may not include HST as displayed when booking. 5.3 Methods of payment include but are not limited to Paypal (for Credit Card processing), Interac Email Transfer or Cash (transfer of funds is provided). 5.4 The event could be structured so that you can select your seat, seat is allocated to you or there are no seats required. 5.5 Your seats are reserved upon clicking the “Pay Now” button located on your booking’s confirmation screen and not when selecting the seats. 5.6 When an order is processed, you will receive an email confirmation at the email provided by you during the booking. If you do not receive this email due to an incorrect email address provided or for other reasons, it is your responsibility to contact us and let us know. Failure to do so may result in the impossibility of us not being able to confirm your transaction. This may result in you not being able to attend the event. 5.7 All tickets purchased through our website are subject to non-refundable fees as stated, either for online or offline processing. By purchasing tickets from our website, you agree to pay these fees and understand that these fees will not be refundable under any circumstances. 5.8 Lost tickets can be replaced and are subject to a $5.00 per ticket replacement fee. 5.9 When purchasing tickets online, please ensure that you are viewing the tickets using only one browser window or tab. Viewing tickets on multiple browser windows or tabs may result in the loss of your booking transaction.
6. Event Terms and Conditions
6.1 Where required or applicable, valid identification must be provided for collection of tickets and upon entry at the event venue. The presenter reserves the right to refuse admission if valid identification is not provided. 6.2 The event organizer reserves the right to add, withdraw or replace any artist, performer or show, and to amend the event programme. This includes venue, prices, date of the event, and/or seating arrangement. 6.3 At times, events are cancelled by the presenter due to circumstances beyond their control, such as weather conditions. If this occurs, please contact the venue for information regarding the procedure for obtaining a potential refund for your ticket(s). If applicable we only facilitate any refunds on behalf of the presenter and these refunds are at the sole discretion and control of the presenter. There may be limitations on refunds set by the presenter if the event is changed, relocated or rescheduled. 6.4 Service, delivery and transaction fees are not refundable. By purchasing tickets from OneGreatTicket, you agree to pay these fees and understand that the fees will not be refunded under any circumstances. 6.5 OneGreatTicket cannot issue any refunds until any outstanding balance for the refunds has been compensated by the event organizer or producer. 6.6 Tickets may be subject to a limited number of tickets that each customer can purchase for an event. This limit will be published as part of the event information, or implied by the number of tikcets available for purchase. 6.7 The presenter reserves the right to refuse admission or to eject you or the ticket holder from the event, without compensation to you, in circumstances where the presenter considers it just cause. This includes (without limitation) where tickets are lost or damaged, where you engage in conduct that unreasonably interferes with the enjoyment of the event by others (i.e. by fighting, being abusive or disorderly, hampering the conduct of the event or otherwise), and where you do not comply with the presenter’s terms and conditions. 6.8 You must comply with all security requirements of the presenter and the event venue in relation to your attendance, which may include (without limitation) you and your belongings being searched on entry, and the confiscation of any prohibited items, such as cameras and recording devices, weapons or alcohol.
7. Refunds and Exchanges
7.1 We do not provide refunds or exchanges on any tickets purchased. Therefore, please ensure that you carefully review your event and seat selection before processing the purchase. 7.2 Service, delivery and transaction fees are not refundable. By purchasing tickets from OneGreatTicket, you agree to pay these fees and understand that the fees will not be refunded under any circumstances.
8. Limitation of Liability
8.1 We do not assume any liability for any loss of any kind arising out of your attendance at an event. Any liability arising is a matter between you and the presenter or other party. 8.2 If you purchase tickets on behalf of others, including minors, you acknowledge that those parties are aware of all terms and conditions relating to their tickets and their entry and attendance at the event. 8.3 To the fullest extent permitted by law, we exclude all responsibility and liability in relation to the event and we will not be responsible or liable for any loss, injury or damage however caused (including to any person or property), including under contract, tort, statute, product liability or otherwise, whether they be direct or indirect, special, incidental or consequential, resulting from the use of this website, your use of or the inability to use the tickets, the cancellation or postponement of the event, or for any other reason whatsoever.
9. Tickets Terms and Limitations
9.1 You must hold a valid ticket to attend the event. Unless tickets are purchased from an authorised sales channel, they may be voided or you may be refused admission. 9.2 Tickets purchased online are available to print from the attachment contained in the confirmation email. If multiple copies of tickets are printed, only the first to be scanned will allow admission. 9.3 No ticket may be resold at a premium, used for advertising, promotion or other commercial purposes without formal written authorisation from us or the presenter. Any breach of this term will result in you or the ticket holder being refused admission or being ejected from the event.
10. Presenter Content
10.1 OneGreatTicket is not responsible for any content posted or displayed on any page within the website by our registered clients or event organizers. Such information does not represent the viewpoints or opinions of our company. 10.3 OneGreatTicket cannot be held responsible for any agreements, contracts, unfulfilled promises or any communication made between one of our clients and a third party. 10.4 OneGreatTicket is not responsible for any illegal or unlawful material — including defamatory or copyrighted material — posted to an event page by a client or presenter on our system.
11. Accuracy of Information
11.1 Users and clients of any services provided by OGT, certify that any information provided to us is complete and accurate. 11.2 OGT will make every effort to validate the billing information you provide to us; however, if we are unable to do so, we reserve the right to cancel your tickets or prohibit you from using this website.
12. Adaptation of Event Listings
12.1 OneGreatTicket reserves the right to remove any event from our website at any time, under any circumstances, and for any reason.
